ASSUMPTION OF RISK, RELEASE OF LIABILITY,
PHOTO/VIDEO CONSENT, AND ARBITRATION AGREEMENT

Welcome to Musecraft Studios LLC, a community-oriented creative studio focused on arts, crafts, and textiles. This Agreement sets expectations for safety, shared responsibility, and participation in our creative community.
This Agreement applies to all forms of participation, including open studio use, memberships, day passes, five-day passes, classes, workshops, events, and any other activities at the studio.
1. Age Guidelines and Supervision
Participants must be at least sixteen (16) years old to use the studio. Participants ages sixteen (16) and seventeen (17) may participate only when accompanied at all times by a responsible adult who is at least eighteen (18) years of age. The accompanying adult is responsible for the minor’s supervision, conduct, and safety during the visit.
2. Assumption of Risk
I understand that participation in a creative studio involves hands-on activities, shared tools, experimentation, and communal space, all of which carry inherent risks. These risks are a normal part of making and learning and may result in injury, illness, property damage, or other harm.
Risks may arise from the use of equipment and materials including, but not limited to, heat guns, hot glue guns, drills, saws, hammers, sewing machines, sharp blades, cutting tools, hand or power tools, and materials that may not be safe for skin contact, inhalation, or consumption, such as adhesives, solvents, finishes, and pigments.
I voluntarily choose to participate and assume all risks, whether known or unknown, inherent or otherwise.
3. Release and Waiver of Liability
To the fullest extent permitted by Minnesota law, I release, waive, and discharge Musecraft Studios LLC, its owners, employees, instructors, volunteers, agents, and affiliates from any and all claims arising out of or related to my participation, including claims related to studio activities, use or misuse of tools or materials, exposure to hazardous materials, or accidents or injuries occurring on the premises.
This release applies to claims based on ordinary negligence, but does not apply to gross negligence or willful misconduct where such exclusions are prohibited by law.
4. Shared Responsibility and Studio Safety
I agree to follow posted rules and staff guidance, use tools only as intended and only if I understand their safe operation, ask questions when unsure, and stop any activity that feels unsafe to me or others. Failure to follow these guidelines may result in loss of studio access for the day or longer, with or without refund, depending on the circumstances.
5. Medical Responsibility
I understand that Musecraft Studios LLC does not provide medical care and that I am solely responsible for any medical treatment or expenses related to my participation.
6. Memberships, Day Passes, and Five-Day Passes
Memberships provide access during designated open hours and are subject to capacity limits, age guidelines, equipment availability, and safety requirements. Membership does not guarantee exclusive use of space or equipment. Monthly memberships renew month-to-month unless canceled according to studio policy. Annual memberships are valid for twelve (12) consecutive months from the start date. Memberships are personal and non-transferable. Musecraft Studios LLC may suspend or terminate a membership, without refund, if a participant’s behavior compromises safety, respect, or shared use of the space.
A Day Pass allows access for one (1) calendar day during posted open hours and expires at the end of that day. A Five-Day Pass allows access for five (5) separate, non-consecutive days and expires six (6) months from the date of purchase unless otherwise stated. Unused days are forfeited after expiration. Passes are non-transferable, non-refundable, and subject to all studio policies. All waivers and dispute resolution terms apply to all access types.
7. Photo, Video, and Audio Recording
Musecraft Studios LLC may photograph, record video, or capture audio of studio activities for purposes including education, documentation, and promotion. By participating, I grant permission for my image, likeness, voice, or appearance to be used without compensation in any media now known or later developed.

If initialed, Musecraft Studios LLC will make reasonable efforts not to use identifiable images or recordings of me in promotional materials. This does not apply to incidental capture, documentation, or security footage, and complete exclusion cannot be guaranteed in shared spaces.
8. Security Cameras
I understand that Musecraft Studios LLC uses security cameras on the premises for safety and operational purposes and that my image may be recorded while in the studio.
9. Arbitration and Dispute Resolution (Minnesota)
Any dispute arising out of participation at Musecraft Studios LLC or this Agreement shall be resolved by binding arbitration, except for eligible claims brought in Minnesota Conciliation Court. Arbitration shall take place in Hennepin County, Minnesota, under the rules of the American Arbitration Association. Minnesota law applies, and the Federal Arbitration Act governs enforceability. Both parties waive the right to a jury trial and agree that claims must be brought on an individual basis only.
10. Severability and Survival
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect. This Agreement survives the end of participation and termination of access.
